These Terms of Service govern your access to and use of our website, online store, products, services, custom-order process, and related communications. By visiting our website, submitting an order request, placing an order, or purchasing from us, you agree to be bound by these Terms of Service.

Please read these terms carefully before using our website or purchasing a product. If you do not agree to these terms, you should not use our website or place an order.

1. Online Store Terms

You may use this website and purchase from Sail Stitch LLC only for lawful purposes.

Customers under 18 years of age should use this website and place orders only with the involvement and permission of a parent or legal guardian.

You may not use our products, website, services, photographs, designs, or other materials for an unlawful or unauthorized purpose. You may not transmit viruses, malicious code, or any material intended to interfere with the operation or security of our website.

2. Products and Services

Sail Stitch LLC offers embroidered, personalized, handmade, custom, and made-to-order products. Product offerings may include hats, apparel, wreath sashes, home décor, accessories, business merchandise, event items, and other products offered through our website or approved through a custom-order request.

We reserve the right to:

• Add, modify, limit, or discontinue products at any time
• Limit quantities available for purchase
• Refuse a custom request or order
• Correct product information or pricing errors
• Substitute unavailable materials only with the customer’s approval when the substitution materially changes the order

Product availability is not guaranteed until an order has been reviewed, confirmed, and paid.

3. Product Images and Colors

We make reasonable efforts to display our products, designs, fabrics, and thread colors accurately. However, colors may appear differently depending on your screen, lighting, photography, and device settings.

Some website or social-media images may be digital renderings, design mockups, or AI-assisted images used to demonstrate product ideas and personalization options.

Digital images and mockups are visual representations. The finished product may vary slightly in color, texture, proportions, pattern placement, embroidery placement, or overall appearance.

These reasonable variations are not considered defects.

4. Handmade and Embroidered Products

Our products may be embroidered, sewn, finished, or personalized individually. Minor differences between products are a normal part of handmade and embroidered work.

Slight variations may include:

• Embroidery placement
• Stitching and thread appearance
• Fabric-pattern placement
• Product measurements
• Monogram proportions
• Colors and textures
• Positioning of names, wording, or designs

Products are not guaranteed to be completely identical to samples, mockups, previous orders, or one another.

5. Personalization Information

Customers are responsible for submitting complete and accurate personalization information.

This includes, but is not limited to:

• Names
• Initials and monograms
• Dates
• Spelling
• Wording
• Sizes
• Colors
• Quantities
• Design selections
• Shipping addresses
• Contact information

Please enter personalization exactly as it should appear on the finished item.

Sail Stitch LLC is not responsible for an error contained in information submitted or approved by the customer. An item completed according to the information provided is considered correctly fulfilled and is not eligible for a refund, exchange, replacement, or store credit.

6. Monograms

Unless otherwise stated, a traditional three-letter monogram should be submitted in the following order:

First-name initial, last-name initial, middle-name initial

The last-name initial is generally displayed larger in the center.

Customers are responsible for confirming the correct order of initials before submitting an order.

7. Customer-Provided Artwork and Logos

When you submit a logo, photograph, phrase, graphic, design, trademark, or other artwork, you represent that:

• You own the material or have permission to use it
• You have the right to authorize its reproduction
• Its use does not violate another party’s copyright, trademark, privacy, publicity, or other legal rights

You are responsible for obtaining any permissions or licenses required to reproduce customer-provided material.

Sail Stitch LLC may refuse or cancel a request that we reasonably believe is unlawful, offensive, misleading, infringing, or unauthorized.

You agree to be responsible for claims, losses, or expenses resulting from your unauthorized use of material submitted to us, to the extent permitted by law.

8. Digitizing and Artwork Preparation

Embroidery designs may need to be digitized or converted into a machine-readable embroidery file.

A digitizing or artwork-preparation fee may apply. This fee will be disclosed before payment whenever applicable.

Digitizing fees compensate for preparing the embroidery file and are not a transfer of ownership of Sail Stitch LLC’s production files, settings, techniques, or working materials.

Unless otherwise agreed in writing, embroidery production files created or purchased by Sail Stitch LLC remain the property of Sail Stitch LLC.

9. Mockups and Design Approval

A digital mockup may be provided for certain custom, personalized, or business orders.

Mockups are used to confirm general details such as:

• Wording and spelling
• Design selection
• Product color
• Thread colors
• Approximate placement
• Overall layout

The customer is responsible for carefully reviewing the entire mockup.

Written approval may be provided through email, text message, social media message, website communication, or another method accepted by Sail Stitch LLC.

Once a mockup is approved, Sail Stitch LLC is not responsible for details that were visible in and approved through that mockup.

Reasonable design revisions may be limited. Additional revisions, major changes, or changes requested after approval may require an additional fee.

10. Orders and Acceptance

Submitting an order, quote request, business-order form, or customization inquiry does not guarantee that we will accept or fulfill the request.

We reserve the right to refuse or cancel an order for reasons including:

• Product unavailability
• Incorrect pricing or product information
• Suspected fraud
• Payment concerns
• Incomplete customization details
• An unavailable completion date
• Unauthorized artwork
• A request that conflicts with our policies
• Circumstances outside our reasonable control

An order is considered confirmed only after payment has been received and all required order information has been provided.

For orders requiring approval, production will not begin until the final mockup has been approved.

11. Pricing

Prices are displayed in United States dollars unless otherwise stated.

Prices may change without notice. A price change will not affect an order that has already been accepted and paid, unless the order is later changed by the customer.

Custom and business-order pricing may depend on:

• Product type and brand
• Quantity
• Garment sizes
• Design dimensions
• Stitch count
• Number of thread colors
• Number of design locations
• Digitizing
• Artwork preparation
• Product availability
• Shipping
• Rush service
• Applicable taxes

Quotes are based on the information available when prepared. Changes to products, quantities, sizes, artwork, or deadlines may result in updated pricing.

12. Payment

Unless otherwise agreed in writing, orders must be paid in full before products are ordered, materials are purchased, or production begins.

Payment may be processed through Shopify or another payment method approved by Sail Stitch LLC.

By submitting payment information, you represent that:

• The information is complete and accurate
• You are authorized to use the selected payment method
• You authorize the applicable charges
• You are responsible for all charges associated with the order

We may delay or cancel an order if payment is declined, reversed, disputed, or identified as potentially fraudulent.

13. Taxes

Applicable sales tax may be collected based on the order, customer location, delivery location, tax status, and applicable law.

Customers requesting a sales-tax exemption or purchasing for resale may be required to provide valid exemption or resale documentation before the order is finalized.

Exemption documentation cannot be guaranteed to apply retroactively after payment has been submitted.

14. Order Changes

Changes are not guaranteed after an order has been submitted or paid.

Once products have been ordered, materials have been purchased, a mockup has been approved, or production has begun, changes may not be possible.

Approved changes may result in:

• Additional charges
• A revised invoice
• A new turnaround estimate
• Additional design fees
• Delayed completion

Customers should review all product selections, quantities, sizes, personalization, and shipping details before submitting payment.

15. Cancellations

Because many products are purchased, prepared, customized, or made specifically for each customer, orders cannot be canceled after they have been submitted and accepted, except where cancellation is required by applicable law.

Sail Stitch LLC may cancel an order that we are unable to complete. If we cancel an order before fulfillment, we will issue an appropriate refund for the canceled portion.

16. Turnaround Times

Turnaround times are estimates unless a completion date has been expressly confirmed in writing.

Turnaround time generally begins after:

1. Full payment has been received
2. All products, quantities, sizes, and colors have been confirmed
3. All personalization details have been received
4. Any required mockup has been approved

Time spent waiting for information, payment, product selection, artwork, or approval is not included in the production turnaround time.

Turnaround times may be affected by product availability, supplier delays, order volume, holidays, weather, equipment issues, shipping disruptions, or other circumstances outside our reasonable control.

17. Rush Orders

Rush service may be available only with prior approval.

A rush fee may apply. Paying a rush fee does not override delays caused by inaccurate customer information, delayed approval, carrier disruptions, unavailable products, or other circumstances outside our reasonable control.

A requested date is not guaranteed unless confirmed by Sail Stitch LLC in writing.

18. Shipping

Shipping charges are calculated during checkout or added to a custom Shopify invoice.

Customers are responsible for providing a complete and accurate shipping address. Additional shipping costs resulting from an incorrect or incomplete address may be charged to the customer.

Tracking information may be provided when the shipping label is created. Tracking activity may not appear until the carrier receives and scans the package.

Delivery dates supplied by a shipping carrier are estimates and are not guaranteed by Sail Stitch LLC.

Nothing in these terms limits any cancellation, refund, replacement, or other rights that cannot legally be waived.

19. Delayed, Missing, or Delivered Packages

Once a package is transferred to the shipping carrier, the carrier controls transportation and delivery.

Customers should first review the tracking information and contact the carrier regarding delays or delivery concerns.

If a package is marked delivered but cannot be located, the customer should:

• Confirm the shipping address
• Check around the delivery location
• Ask household members or neighbors
• Contact the carrier
• Notify Sail Stitch LLC promptly

Sail Stitch LLC will provide reasonable assistance with available shipment information but cannot guarantee carrier investigations, recovery, or replacement of packages marked as delivered.

20. Local Pickup

Local pickup may be available for certain orders.

Customers must wait until they receive confirmation that the order is ready. Please do not arrive for pickup before receiving that notification.

Pickup instructions, availability, and location information will be provided directly to the customer.

Orders must be collected within the communicated pickup period. Unclaimed orders may be subject to additional storage, shipping, or redelivery arrangements.

21. Customer-Provided Items

Items supplied by a customer for embroidery or personalization are accepted only with prior approval.

Embroidery and customization involve machinery, needles, heat, pressure, adhesives, and other production processes. Although customer-provided items are handled with care, unexpected damage may occur.

To the fullest extent permitted by law, Sail Stitch LLC is not responsible for replacing or reimbursing customer-provided items damaged during an approved customization process, unless the damage results from conduct for which liability cannot legally be excluded.

Customers should not ship or drop off an item without receiving approval and instructions first.

22. Returns, Exchanges, and Refunds

All sales are final.

Sail Stitch LLC does not accept returns, exchanges, or refunds for custom, personalized, embroidered, handmade, made-to-order, business, or bulk-order products, except where required by law or when Sail Stitch LLC sends an item that is materially different from the confirmed order.

Customers must notify us of an incorrect item within three calendar days of delivery and provide:

• Their name
• Their order number
• A description of the issue
• Clear photographs of the item
• Photographs of the packaging when applicable

The item must not be used, washed, altered, worn, or returned without authorization.

After reviewing and confirming the issue, Sail Stitch LLC may repair the item, replace the affected item, provide another appropriate resolution, or issue a refund if the correct item cannot reasonably be provided.

23. Care Instructions

Customers are responsible for following all product-care instructions and manufacturer labels.

Sail Stitch LLC is not responsible for damage caused by:

• Improper washing or drying
• Bleach or harsh chemicals
• Excessive heat
• Ironing directly over embroidery
• Alteration or misuse
• Pulling, cutting, or disturbing stitches
• Failure to follow the original manufacturer’s care label

24. Promotions and Discount Codes

Promotions and discount codes may be subject to additional restrictions, expiration dates, product exclusions, and quantity limits.

Unless otherwise stated:

• Discounts cannot be combined
• Discounts cannot be applied after an order is placed
• Discounts have no cash value
• Discounts may not apply to custom quotes, business orders, rush fees, shipping, taxes, or digitizing

We may cancel or correct a promotion that contains an error or is used in a fraudulent or unauthorized manner.

25. Errors and Inaccuracies

Our website may occasionally contain typographical errors, inaccuracies, or omissions related to product descriptions, prices, promotions, shipping charges, availability, or turnaround times.

We reserve the right to correct errors, update information, or cancel an affected order.

If a paid order is canceled because of our pricing or listing error, we will refund the amount paid for the canceled portion.

26. Intellectual Property

Unless otherwise stated, the website and its original content—including photographs, graphics, text, logos, branding, product descriptions, mockups, layouts, and original designs—are owned by or licensed to Sail Stitch LLC.

You may not copy, reproduce, distribute, modify, sell, publish, or commercially use our content without prior written permission.

Purchasing a physical product does not transfer ownership of the related artwork, embroidery file, photograph, product design, branding, or other intellectual property.

27. Photographs of Completed Work

Unless otherwise agreed, Sail Stitch LLC may photograph completed work and use those photographs to display our craftsmanship, products, and services on our website, social media, portfolio, or promotional materials.

Customers who do not want their completed order photographed or shared should notify us in writing before production begins.

We will not intentionally publish private customer information such as a home address, telephone number, email address, or payment information.

28. Reviews, Feedback, and Submissions

If you submit a review, photograph, testimonial, suggestion, or other feedback, you represent that the submission is accurate, lawful, and does not violate another person’s rights.

You grant Sail Stitch LLC permission to use, reproduce, edit for length or formatting, and display that submission in connection with our business and marketing, unless prohibited by law.

We are not obligated to keep unsolicited ideas confidential, pay compensation for them, or use them.

29. Prohibited Uses

You may not use our website or services to:

• Violate applicable laws or regulations
• Infringe intellectual-property rights
• Submit false or misleading information
• Harass, threaten, or harm another person
• Upload malicious code
• Collect customer or website-user information without authorization
• Attempt to interfere with website security
• Scrape, reproduce, or commercially exploit website content
• Place fraudulent orders
• Misrepresent your authority to use a logo or design

We may restrict access or cancel an order when prohibited activity is suspected.

30. Third-Party Services and Links

Those services may be governed by their own terms and privacy policies. Sail Stitch LLC does not control and is not responsible for the availability, content, security, or practices of independent third-party services.

Your use of a third-party service is at your discretion and subject to that provider’s terms.

Personal information submitted through our website is handled according to our Privacy Policy.

By using our website or placing an order, you acknowledge that certain information may be processed by Shopify, payment providers, shipping carriers, or other service providers as necessary to operate the store and fulfill your order.

32. Disclaimer of Warranties

To the fullest extent permitted by law, our website is provided on an “as available” basis.

We do not guarantee that the website will always be uninterrupted, secure, or error-free.

Nothing in these terms excludes any warranty, guarantee, or consumer right that cannot legally be excluded.

33. Limitation of Liability

To the fullest extent permitted by law, Sail Stitch LLC and its owner, employees, contractors, and representatives will not be liable for indirect, incidental, special, punitive, or consequential damages arising from the use of our website, products, or services.

Where liability cannot be completely excluded, our total liability relating to a particular order will not exceed the amount paid to Sail Stitch LLC for the product or service giving rise to the claim, except where applicable law requires a different result.

34. Indemnification

To the fullest extent permitted by law, you agree to indemnify and hold Sail Stitch LLC harmless from third-party claims, damages, liabilities, and reasonable expenses resulting from:

• Material or artwork you submit without authorization

The remaining provisions will continue in full force and effect.

36. Waiver

Our failure to enforce a provision of these Terms of Service does not waive our right to enforce it later.

37. Entire Agreement

These Terms of Service, together with our posted policies, product descriptions, approved quotes, invoices, and written order agreements, constitute the agreement between you and Sail Stitch LLC regarding your use of our website and purchase of our products.

If a written custom quote or order agreement contains terms that conflict with these general terms, the more specific written terms will control for that order.

38. Termination

We may suspend or terminate access to our website or services if you violate these terms or engage in conduct that threatens our business, customers, website, or legal rights.

Obligations and liabilities incurred before termination will survive termination when applicable.

39. Governing Law

These Terms of Service are governed by the laws of the State of North Carolina, without regard to conflict-of-law principles, except where the mandatory consumer-protection laws of another jurisdiction apply.

Any legal proceeding relating to these terms or an order must be brought in a court with proper jurisdiction over Pitt County, North Carolina, unless applicable law requires otherwise.

40. Changes to These Terms

We may update these Terms of Service periodically by publishing a revised version on our website.

Changes apply beginning on the stated effective date and do not retroactively change the terms governing an order that was already accepted, except where required by law or agreed to by the customer.

Continued use of the website after an updated version becomes effective constitutes acceptance of the revised terms.
